The Amarillo Town Club (the "Club") is a community health promotion program and facility of ATC HEALTH PROMOTION FOUNDATION, a Texas non-profit corporation ("ATC" The ATC Dash & Splash Fun Run ("Event") is a community event to be held on August 9, 2025. The Event is open to the public, including non-members, and will include a free pass to the ATC pool on the day of the Event. All participants in the Event must sign in and accept the terms of this waiver to be eligible. Failure to do so will result in immediate revocation of the participant's registration and day pass to the pool, with no refund issued except in extraordinary circumstances.

PLEASE REVIEW THE FOLLOWING WAIVER CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS.

PARTICIPANT WAIVER: By signing in to the club, I acknowledge that my participation in the Event is entirely voluntary, and

carries with it inherent risks to my person and property. As such, I agree that neither ATC nor its directors, officers, employees, agents, or representatives will be responsible for any damage to myself or my personal property in connection with my participation in the Event or use of the Club's facilities. I am solely responsible for any injuries or damages to myself, as well as any injuries or damages that I cause to a third party in connection with my participation in the Event and/or use of the Club's facilities. I understand that if I choose to bring any personal belongings to the Club's facilities, ATC will not be responsible for any loss, theft, or damage to such belongings.

I represent that I am either 18 years old or that I have parent authorization to participate in the Event. I understand that I should not participate in the Event if I have any preexisting injury or health concern that might hinder my participation. I understand that ATC cannot and will not provide medical advice regarding my fitness to participate in the Event, and I must seek the advice of a physician to determine the safety of my participation. In the event of a medical emergency, I authorize the Club to provide first aid and any emergency medical treatment deemed necessary, for which I will be financially responsible.

I AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS ATC AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND REPRESENTATIVES FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, DAMAGES, CAUSES OF ACTION, SUITS, AND/OR LIABILITY, INCLUDING ATTORNEYS' FEES, THAT RESULTS FROM MY PARTICIPATION IN THE EVENT AND USE OF THE CLUB'S FACILITIES, REGARDLESS OF WHETHER SUCH LIABILITY RESULTED IN WHOLE OR IN PART BY THE NEGLIGENCE OF ATC OR THAT OF ANY OF ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR REPRESENTATIVES.

I agree to comply with the rules, regulations, and policies of the Club, which may be amended from time to time by ATC. I understand that violation of the rules, regulations, and policies of the Club may result in immediate revocation of my Event

registration and day pass to the pool.

I am authorized to agree to the terms of this document on behalf of the registrant. If the registrant is under 18 years of age, incapacitated, or mentally challenged, I assert that I am the parent/legal guardian or otherwise authorized to execute a legally binding agreement on behalf of the registrant. I authorize ATC to take, make, use, and reproduce my name, image, likeness, and/or voice in any photographs, videos, or other media, whether taken or made by ATC or by anyone else for its benefit and use for any and all lawful purposes, including publication and advertising for the Event.
